(Green, 2015) The topic of homosexuality and same sex marriage is one that probes the primary question of whether or not same sex marriages are ones fundamental right under both the Due Process Clause and Equal Protection Clause of the Fourteenth Amendment. (Lempert, 2015) The case of Obergefell v. Hodges was a case that held that the Fourteenth Amendment requires all states to recognize and grant same sex marriage licenses to couples that have been granted that right in other jurisdictions. This case may be considered a significant decision of the United States†¦show more content†¦(Originalist v. Activism Interview) Instead of defining the constitution based on the context and values of the world the Framers knew, judges must decide cases based on the social conditions of future generations or how society’s views are going to evolve throughout time . (Originalist v. Activism Interview) Justice Kennedy did just that. He concluded his opinion in Obergefell by describing marriage is a profound union and that the nature of marriage â€Å"embodies the highest ideals of love†. Although the statements made by Kennedy were not really relevant to the core legal issues in the case of Obergefull v. Hodges. Since that was the case, how could the decision of a landmark Supreme Court case that was decided on mere judicial opinion be considered a significant decision of the US Supreme Court when analyzing Constitutional History? It can’t. Obergefell v. Hodges was not decided with legal precedent, but instead it was decided on mere judicial opinion.

Underground Railroad in Delaware, Maryland, and West Virginia For this critical review, I chose Underground Railroad in Delaware, Maryland, and West Virginia by William J. Switala. The purpose of this book was to explain exactly what the underground railroad was, how the slaves communicated with safe places, how it operated, and a few stories of how some of the slaves escaped away to the underground railroad and freedom. He also gives insight to what happened if the slaves were caught trying to escape or caught by another slave owner. Not to mention if a slave took a wrong turn or did not follow the signs left by others that had found freedom. He could find himself caught in broad daylight trying to escape. In one account, Switala talks about James W. C. Pennington in one case. He had a minimum amount of food that he could bring with him, a half-pound piece of cornbread to be exact. The food he took with him had only sustained him for a few days. He was captured by another slave owner and had to plan another escape once again. Pennington had eventually ended up at the residence of Quaker W. W. and finally found his freedom. In this case, it was insane to see all the trials and tribulations that a slave had to go through just to get to freedom. Pennington was asked if he had his freedom papers and he lied saying yes as well as other lies that he composed along the way. I think it was wrong that an individual, a human being, had to go through so much just to be treated like a â€Å"white individual† at the time. Slaves were nothing more than property to most and some were even more valuable than others due to the trade skills that they knew or learned. I think one reason that it was hard for some of the slaves to escape is that there were so many different routes to choose from to get to safety. Cloning Benefits Cloning Benefits What if while walking down the street you encountered someone who looked exactly like you? Would you stare in amazement or would your heart be filled with fear? At first some people may look upon the idea of cloning with disgust and question themselves if humans should play God while others would be interested and study the many possibilities that cloning offers. This illustrates the path that cloning has taken over the latter part of the twentieth century. At first, when cloning was brought up in conversations, people tended to fearfully think of an army of identical persons marching across the earth in hopes of ruling humans. This and many other absurd notions of clones stem from science fiction movies and books where clones are distorted into horrid, monstrous beasts. In Ira Levin's science fiction book, The Boys of Brazil, baby Hitlers are cloned in order to take over Hitler's dream of his race dominating the world (Harris 361). This distortion was, and still is, a common misconception of the goals of cloning. In reality, cloning, along with its counterpart gene therapy, is not intended for the production of a fully developed individual. Instead, cloning and gene therapy are about the medical advancement of the world's population through the control of diseases and replacement of missing hormones and organs. Although there are arguments against them, the possibilities of cloning and gene therapy are important for the production of organs and hormones and as a means to control diseases, but both must also be strictly regulated in order to outlaw the production of fully-developed human clones. Until 1997 the chance of mammalian cloning seemed just about as unlikely as finding a cure for AIDS. However, 1997 marked the beginning of the wonderful technology known as mammalian cloning. In that year scientists in Scotland cloned, for the first time, a sheep (The Future 46). Since then people think that biologists are cloning both human and other m ammal's embryos only to see how far they can push the scientific envelope, but in fact there are many legitimate reasons for investigating cloning. Embryologists believe that research into cloning could help improve the life of future generations. Cancer research is possibly the most important reason for embryo cloning they argue. Oncologists believe that embryonic study will advance understanding of the rapid cell growth of cancer. Cancer cells develop at approximately the same phenomenal speed as embryonic cells do. Personality Of The Crisis Worker I agree that not everyone is suitable to do crisis intervention work as there are many factors that need to be considered when doing crisis work. The main factor that is essential for any crisis intervention work is the characteristics and personality of the crisis worker. James Gilliland (2001, p.17) claim that effective crisis workers share a number characteristics and such workers demonstrate competency in their professional skills. Before we analyze the crisis worker, we need to understand crisis, crisis intervention and the difference between other therapies and crisis intervention because of the need to understand how the role of the intervener differs from other therapies and what are the characteristics that is needed specifically for the crisis intervention. There are many definitions of crisis but a summarized definition would be that crisis is a perception or experiencing of an event or situation as an intolerable difficulty that exceeds the persons current resources and coping mechanisms, (James Gilliland, 2001, p.3). A similar definition of crisis is by Roberts (2000) who views crisis as a period of psychological disequilibrium, experienced as a result of a hazardous event or situation that constitutes a significant problem that cannot be remedied by using familiar coping strategies (p.7). There are many types of crisis and crisis is not simple but is complex and difficult to understand. It is essential that the individual is able to get relief from the crisis because the crisis causes disruption and breakdown to an individuals ongoing pattern of everyday functioning. If the crisis is not handled, the situation would tend to immobilize them and they will be unable to control their lives. Apart from that, a crisis can cause individua ls to have affective, behavioural and cognitive malfunctioning. Crisis intervention is an internal helping response and is defined as methods used to offer short term immediate help to individuals who have experienced an event that produces mental, physical, emotional and behavioural distress, (Mitchell, n.d. para.1). The ultimate goal of crisis intervention is reducing the dangers of the crisis and allow it to be resolved positively allowing the individual to go on and thrive in life (Echterling, Presbury, McKee, 2005, p.25). This intervention will focus on resolving the immediate problem to prevent further deterioration and to prevent negative outcome. An article by Center for School Mental Health Assistance (2002) states that, crisis intervention will restore a sense of equilibrium for the individual in crisis and give them the ability to creatively problem-solve and feel efficacious. Crisis intervention differs from other therapies and traditional counselling because it focuses on short term strategies to prevent damage during and immediately after the experience of trauma, (Mitchell, n.d. para.5). This intervention is oriented in the present and focuses on the immediate problem which disrupts people from controlling their life. The interveners role is to offer immediate assistance to the individual who is struggling with a complex situation and assist them to go on and achieve a meaningful resolution (Echterling, Presbury, McKee, 2005, p.25). In comparison to crisis intervention, other therapies deal with the totality of the individuals personality and life issues and tend to be long term as they aim to improve the clients mental health and personal wellbeing with an attempt to remediate more or less ongoing emotional problems. This only escalates to a crisis when there are threats to fulfilment, safety or meaningful existence (James Gilliland, 2001, p.8-9) an d this is where the crisis worker takes over. To be a crisis worker, the helper has to have certain qualities to be able to intervene during the crisis and life experiences of the intervener are an important aspect to handle a crisis. These life experiences serve as a resource for emotional maturity that combined with training, enables workers to be stable, consistent and well integrated not only within the crisis situation but also in their daily lives (James Gilliland, 2001, p.13). When a worker has previous experience of going through a crisis and comes across another individual who is in the similar crisis, they will be able to use their background as a resource to deal with the crisis. For example a crisis worker has previously made suicide attempts and has dealt with it, now has a client who is on the verge of attempting suicide. The crisis worker will be able to help the client overcome the issue because of the first hand experience of the crisis. James Gilliland (2001) suggest that people who usually do crisis interven tion are products of their own crisis environment and they have chosen to work with people experiencing the same kind of crisis they themselves have suffered, and they use their experiential background when working with people in crisis (p.13). Apart from this, life experiences means the helper has emotional maturity and it can enhance the dept and sensitivity with which the clients are treated. One other characteristic that is essential for a crisis helper is remaining poised because the nature of crisis intervention is that the worker is often confronted with shocking and threatening materials from clients who are completely out of control, (James Gilliland, 2001, p.14). When a helper remains poised in a situation where the client is out of control, there are chances that the stress level of the client will not be escalated. As the helper models this trait to the client, soon a stable atmosphere and a state of composure can be achieved. Eventually the situation will be brought into control and any immediate danger will be diffused. This trait of calming the victim and the situation has to be deeply abided within the helper and cannot be taught. Aguilera Messick (1982) stated that creativity and flexibility are major assets to those confronted with perplexing and seeming unsolvable problems (p.24). All crisis helpers are equipped with many skills and these skills have to be used in specific and creative ways personalized to the clients needs and crisis. Sometimes to solve the crisis, untraditional and unconventional approaches need to be used. Helpers also cannot approach a crisis with a fixed and rigid formula but instead should have a tentative plan for how to address it, combined with a readiness to let go of that approach if it does not work, (Miller, 2012, p.6). Creating solutions is time sensitive and by being flexible to try and use different approaches, the helper will be more effective to lead the client through a comfortable intervention. Energy and resiliency are required for crisis intervention as crisis situations can be very demanding. Being energized is largely dependent on the worker themselves to take care of their own physical and psychological needs so that their energy level remains high (James Gilliland, 2001, p.15). Resilience on the other hand is also essential because it is natural for helpers to face failure no matter how capable or committed they were and when times of failure arise, helpers need be able to move forward and not face a meltdown. As mentioned previously, crisis intervention compared to other therapies is time critical and helpers must have quick mental reflexes to deal with the constantly emerging and changing issues that occur in the crisis, (James Gilliland, 2001, p.15). Helpers need to be able to think quickly on their feet and make quick evaluations and decisions as there is no time to reflect and slowly mull over the crisis. There is also a need for the helper to be comfortable in making decisions on their own because most of the time, they do not have another person supervising them. Finally, one of the other trait a crisis helper should posses is the potential and desire to grow and change. Doing crisis intervention is not a static work as there is constant and rapid change in this field. The helper needs to change after each contact with a client because successful resolution of the crisis results in two products, the first is helping the client overcome the crisis and second, effecting positive change in the helper as a result of the encounter, (James Gilliland, 2001, p.15). In conclusion, I agree that not everyone is suitable to do crisis intervention because a crisis requires helpers who share a number of characteristics to demonstrate competency in their professional skills. Cinco de Mayo "After Mexico gained it's independence from Spain in 1821, it faced internal power struggles that left it in a volatile state of rebellion and instability for years." In 1846, the Mexican government, under the dictator Santa Anna, went to war with the United States. As an outcome of that war, Mexico lost a large amount of land--the land we now know as Texas. In 1854, Juan Alvarez and his troops led a successful revolt to drive Santa Anna out of power. One of Alvarez's strongest supporters was a man by the name of Benito Juarez, a Zapotec Indian leader. In 1855, Juarez became the minister of Justice under the new regime and issued two new controversial laws. One denied the right of the church and military courts to try civilian cases and the other made the sale and distribution of church lands legal. Many people disagreed with these laws and for three years a civil war raged between the two sides. In 1861 Juarez took control of the capital, Mexico City, and put his new Const itution into effect. Not only had Juarez's laws split the country, they had caused the civil war that left Juarez in debt to Spain, England, and France. The three countries were concerned about the debt, so they held a meeting in London, at which Spain and Britain decided to waive the debt in exchange for military control of the Custom House in Vera Cruz. France did not agree to these terms and invaded Mexico in 1861 in hopes of defeating the country and disposing of Juarez. The French troops--deemed among the best trained and equipped in the world--marched into the city of Puebla on May 5, 1862, expecting no resistance. The French army consisted of 6,000 men under the command of Marshal Lorencz. The French were met by an armed force of 2,000 peasants under the command of General Ignacio Zaragoza. This book was easy to read with Valentis short essays and thoughts on modern feminism, stereotypes, and heightening ones awareness to pervasive myths about women. Double standards are nothing new. Women deal with them every day. Take the common truism that women who sleep around are sluts while men are studs. None of the information was really unexpected or suprising to me because it’s all true. Every women is stereotyped by the way she talks, the way she dresses, her personality, etc, while a man isn’t really stereotyped because people think it’s ok for men to do the things they do, that it makes him look like a stud not a player. The examples Valenti uses are familiar and widespread: he’s tough, she’s a tomboy; he’s a bachelor, she’s a spinster; he’s angry, she’s PMSing; he’s successful, she’s a showoff. Although some of their poems discuss themes of depressing nature, on a wider scale both Blake and Donne write poetry which is not only uplifting but also inspiring and extremely worthwhile to read.    The two main themes covered by these two writers are love and death. The poems which use love as the main theme inspire the reader and offer hope that true love exists and is not a fragment of their imagination. The feelings that are discussed in these poems are feelings that all people can experience but are difficult to describe and put into words. This is what makes the poetry so worthwhile to read, to see how the feelings that relate to love are expressed and how they are shown with images and other writing styles.    A Valediction: Forbidding Mourning by John Donne was written to express his feelings for his lover. The poem talks about the feelings of love being so intense that nothing will ever dull the bond between the two souls. A Valediction: Forbidding Mourning is uplifting because Donne talks of a â€Å"love so refined that ourselves know not what it is,† in other words a love so perfect it cannot be explained. This is what makes the poem because Donne has said the love cannot be explained but then he goes on to explain what the two people are feeling and it is done in a way that can never be reproduced or attempted by other poets. This poem is as perfect as the love it describes. Donne explains how the love that is shared by the two is a love that is not affected by sensory things. â€Å"care lesse eyes, lips and hands to misse,† or don’t think that being apart dulls this love, because the love is so strong that even the non-existence of one or both partners cannot bri ng an end to the intense love felt by both. A Valediction: Forbidding Mourning is also talking about death however it does not affect the uplifting nature of the poem because Donne is saying that even in death true love never dies.    The Sunne Rising also written by John Donne is a story about how he and his lover try to convince the sun to return later so they can stay together.

Literary theory and poetry materialize concurrently, for poets have a strong tendency to form opinions about their craft and to use these opinions as part of the message of their poems. Imagination is undoubtedly inherent in literature, the prime component in any work of art, but this view has been a cause of debate since the dawn of literature and criticism. As with most dissentions and philosophy regarding literature and its attendant features, the first records of this debate are to be found in the germinal works of Aristotle and Plato. Writing at a time when the poet was venerated for his work, and the philosopher persecuted for his, it is but natural that Plato would react negatively towards poetry. He regarded it as being fundamentally unsound and his view of imagination was much the same, since the imagination is the wellspring from which poetry arises. Imagination was inspirational and emotional, and he did not agree or identify with it for he did not find it logical. Aristotle, on the other hand, acknowledged that art represented reality, and that imagination was an important element of the structuring and creating of art. Horace, while admitting that poets utilized â€Å"fiction and often mingled facts with fancy†, put forth a synthesis of Aristotle and Plato’s views. According to him, the end function of poetry is to please and instruct, â€Å"†¦ a mixture of pleasure and profit appeals to every reader†¦ † and hence, imagination took on a fairly central position. John Dryden, a Seventeenth Century liberal and neo- classical critic, acknowledged imagination as â€Å"inspiration breath’d into man by God. † Increasingly we observe that, as it is investigated down the ages, the primary human faculty of imagination becomes inseparable from poetry- Dryden acknowledged both the didactic and aesthetic nature of poetry. The term ‘Fancy†, so commonly used, was coined by him. Pope, in accordance to the vigorous structural formalism of the Augustans, declares that imagination was â€Å"native†, but that it should be kept under control, for there was a necessity for decorum. In the Seventeenth Century, the writer became of soul importance- the readers reacted to the experience of emotion with delight. This ‘delight’, the Romantics stressed, was the prime objective of their poetry, but was not achieved by mechanical application of rules, but by the strength of the imagination. An early and somewhat haphazard attempt on the part of Wordsworth to discriminate between ‘imagination’ (â€Å"Impressive effects out of simple elements†), and ‘fancy’ (â€Å"Pleasure and surprise†¦ excited by sudden varieties of situation and accumulated imagery†), appears in â€Å"The Thorn†. In earlier discussions, both of these had been in most part used synonymously to denote a faculty of the mind which is distinguished from ‘reason’ and ‘judgement’, and which receives ‘images’ from the senses and records them into new combinations. He stresses that ‘imagination’, and not ‘fancy’, should be used to refer to the creative or poetic principle. The distinction between imagination and fancy was a key element in Coleridge’s theory of poetry, as well as in the general theory of the mental processes. This laconic differentiation is the core of his exposition on â€Å"the nature and genesis of the imagination. † M. H. Abrams, in â€Å"The Mirror and the Lamp†, points out that, â€Å"As in his philosophy, so in his criticism, Coleridge roots his theory in the constitution and activity of the creative mind. † The memory, for Coleridge, is â€Å"mechanical†, and fancy â€Å"passive†, which acts only â€Å"by a sort of juxtaposition†. The imagination, on the other hand, â€Å"recreates†, its elements by a process to which Coleridge sometimes applies terms borrowed from the physical and chemical unions- it is a â€Å"synthetic†, a â€Å"permeative† and a â€Å"blending, fusing power†. The imagination is â€Å"essentially vital†; it â€Å"generates and produces a form of its own. † Fancy is thus a perfunctory process which receives the elementary images- the â€Å"fixities and definites† which it receives from the senses, and without altering the parts, reassembles them into a different spatial and temporal order form that in which they were originally perceived. The imagination creates rather than reassembles by dissolving the fixities and definites, and unifying them into a new whole. The faculty of imagination â€Å"generates and produces a form of its own† while its rules are â€Å"the very powers of growth and production. † It assimilates and synthesises the most disparate elements into an organic whole- a newly generated unity, constituted by a living interdependence of parts whose identity cannot survive their removal from the whole. Fancy can be taken to mean surface decorations of new combinations of memories and perceptions, while imagination involved a combination of elements in the cauldron of the poet’s mind, with imagination acting as a base of sorts more than anything else, which results in the creation of a new work. Coleridge further distinguishes between the Primary and Secondary imagination. If the process of creation is conceived as being essentially and perpetually the bringing of order out of chaos, then the Primary imagination is essentially creative and â€Å"a repetition in the finite mind of the eternal act of creation in the finite I AM. † This could be explained by reducing imagination to a single image, or a train of thought, in one’s mind- this quality, being inherent in every conscious, human being (that is, in evolutionary terms, the ability of foresight and being able to think around a situation), and Coleridge has recognized this as constituting the Primary imagination. The Secondary imagination is the conscious human use of this power. When we employ our Primary imagination in the act of perception, we are not doing so with our conscious will, but are exercising the basic faculty of our awareness of ourselves and the external world; the Secondary imagination is more conscious and less elemental, but it does not differ in kind from the primary. In imagination, elements in an environment that strike the creator’s sensibility are blended and fused into a new whole- the poet has to merge reason and emotion, restraint and spontaneity, the abstract and the concrete, etc. The entire exercise is a â€Å"reconciliation of opposites†, (precisely why it is a conscious one), emphasizing the dialectical character of creativity. The action can be reduced to three basic phases: thesis, antithesis and synthesis, but this process is inexplicable, as is imagination, and particular to the poet himself. The resultant exposition can never be stripped down to its original elements. To exemplify this, Coleridge uses the analogy of the transformation of a seed into a plant to explain this theory. Once the seed has been planted, and grows into a plant, it is impossible to reduce the plant to singular elements like the seed, the water, the air, the soil, etc. It is a whole- an organic unit. In the same manner- a creation of the imagination has an inherent organic unity- it cannot be reduced to any of its contributory elements. This is the dialectical character of creativity that involves synthesis- the result of this blend and fusion is a whole. Coleridge stressed that imagination makes â€Å"new perception possible†. If indeed a work springs out of imagination, it holds the ability to penetrate the experience of its genesis and reveal the essence of the object. This echoes Aristotle’s view that poetry or art penetrates through the idea of an object and brings to the surface not the particular, but the universal in the particular, the essence. In a writer’s imagination, thus, the experience is unifying or coadunative- what Coleridge calls â€Å"Esemplastic†- it is moulded into an expression by the imagination. Literature thus becomes a piece of actuality subjected to the laws of imagination. Most critics after Coleridge tended to make fancy simply that faculty that produces a lesser, lighter, or more humorous kind of poetry, and to make imagination the faculty that produces a higher, more serious, and more passionate poetry. However, the mark of Coleridge’s theories is undoubtedly present in each of these. As he himself has stated: â€Å"I laboured at a solid foundation, in the component faculties of the human mind itself and their comparative dignity and importance. â€Å"
